Online Casino Permitted to Get Into German Market
9th November, 2007
After the lower court tried to prevent Australian casino group from providing services to German nation, there was not much hope for Bwin. It all turned around last week, when the Administrative Court of Appeal in the central German state of Hessen overruled the lower court decision and decided to let Bwin include German gamblers in their customer database.
The court in Wiesbaden released this statement: “We considered the practicalities of the case and concluded that the impossibilities of enforcing a ban on Internet gambling rendered the law ‘null and void’ for all intents and purposes.”
Even though Germany is a full member of the EU, the monopolistic policies still continued their operations and work in the country. That is in spite of all EU countries being obliged to permit free passage of trade and services to other EU members.
It is clear that Germans are not willing to oblige to that regulation and the competition commission has even stated to the European Court of Justice, that they might open up restrictive markets. European Commission has been successful in forcing other EU members to obey the shared principles of free trading. German officials, on the other hand do not seem willing to conform, and have even planned a get together of the heads of Germany’s 16 States which will be aimed at trying to find a way to keep their beneficial monopolistic policies set in place at the moment. The meeting is scheduled for the end of this year.
